The CFTC’s 5 November interpretation gives designated contract markets 30 days to stop domestic geographic restrictions that breach Regulation 38.151(b), or explain to its Division of Market Oversight why compliance is not feasible. The rule requires competitive, open, fair and impartial access.
Within the same period, venues should also ensure that intermediaries accessing their markets comply and do not impede impartial access, or give the same explanation. The commission says it will consider each case’s facts and circumstances. The notice addresses domestic geographic restrictions and is not a blanket statement about cross-border customer eligibility.
