Apex Clearing Corporation agreed to a $250,000 fine and censure over margin supervision in a FINRA settlement reported on 4 November. The case concerns customers introduced by other brokers whose positions and balances were not properly aggregated across multiple accounts with the same introducing firm. It addresses historical supervision, not a new margin rule.
Between January 2020 and June 2022, over 270,000 retail clients had about 712,000 margin accounts; roughly 61,000 customers carried balances in 152,000 accounts. About 18,000 balance-carrying clients had at least three accounts, including 130 with ten or more. Account-by-account monitoring obscured intraday limits applicable at the time, and a restriction on one account did not automatically cover the customer’s others.
Apex began limiting new multiple accounts in mid-2022 and had introduced aggregation by January 2023, later consolidating accounts into master/subaccount structures. FINRA’s findings link inadequate supervision of Regulation T and Rule 4210 compliance to violations of Rules 3110 and 2010. The historical remediation dates should not be presented as changes first made in November 2026.
